Connect Pro — Terms of Service

1. About these Terms
These Terms of Service govern access to and use of Connect Pro.
Connect Pro is operated by SINGH GROUP IT SERVICES PTY LTD (ACN 694 557 956, ABN 17 694 557 956), trading as Tassie Tech IT Services ("Tassie Tech IT Services", "we", "us" or "our").

By creating an account, accepting these Terms or using Connect Pro, you agree to these Terms on your own behalf or, where you use Connect Pro for a business or organisation, confirm that you have authority to bind that business or organisation.
If you do not agree to these Terms, you must not use Connect Pro.
2. Connect Pro
Connect Pro is a software service designed to help businesses manage enquiries, forms, customer communications, internal notes, assignments, notifications and related business workflows.
Features may change as Connect Pro develops. We may add, modify or discontinue features where reasonably necessary to improve, secure or maintain the service.
We will take reasonable steps to give advance notice where a material change is likely to substantially reduce functionality available to an existing customer, except where an immediate change is necessary for security, legal or operational reasons.
3. Accounts and Workspaces
You must provide accurate information when creating an account.
You are responsible for keeping your authentication credentials secure and for activities carried out through your account, except to the extent caused by our breach of these Terms or applicable law.
A Connect Pro Workspace represents a business or organisational account.
The person who initially creates a self-service Workspace may be assigned the OWNER role. Workspace Owners and other authorised administrators are responsible for managing access granted to members of their Workspace.
You must not share accounts between individuals where Connect Pro provides separate user accounts.
You must notify us promptly if you reasonably believe an account or Workspace has been compromised.
4. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms.
If you use Connect Pro for a business or organisation, you represent that you have authority to use the service on its behalf.
Initial self-service availability may be limited by country or region.
5. Customer Data
"Customer Data" means information, content, files, form responses, enquiry messages, contact information, attachments, internal notes and other information submitted to or stored in Connect Pro by you, your Workspace users or people interacting with your forms.
As between you and us, you retain ownership of your Customer Data.
You grant us a non-exclusive licence to host, copy, transmit, process and otherwise use Customer Data only to the extent reasonably necessary to provide, secure, maintain and support Connect Pro, comply with law, and enforce these Terms.
We do not obtain ownership of your Customer Data through this licence.
6. Your responsibilities for Customer Data
You are responsible for determining what information your business collects through Connect Pro and ensuring that you have lawful authority to collect, use and communicate that information.
You are responsible for providing any privacy notices, consents or other disclosures required for your own business activities.
You must not use Connect Pro to collect or process information in a way that is unlawful, misleading, discriminatory or inconsistent with our Acceptable Use Policy.
Connect Pro may technically allow forms or messages to contain information that is sensitive or confidential. That capability does not mean that every category of information is suitable for the service. You remain responsible for determining whether Connect Pro is appropriate for your intended use and for any additional legal requirements applying to your industry.
7. Public forms and communications
Connect Pro may allow you to publish forms accessible through public links.
You are responsible for the content of your forms and for ensuring your forms do not misrepresent your identity, purpose or relationship with another person or organisation.
Connect Pro may send transactional communications related to enquiries, form submissions, account security and operation of the service.
You must not use Connect Pro to send unlawful unsolicited commercial electronic messages, spam, phishing messages or other prohibited communications.
8. Acceptable Use Policy
Your use of Connect Pro is also subject to the Connect Pro Acceptable Use Policy.
A material breach of that policy is a breach of these Terms.
9. Third-party services
Connect Pro relies on third-party infrastructure and service providers for functions such as hosting, email delivery, security and other technical operations.
Third-party service interruptions may affect Connect Pro.
Where Connect Pro provides an optional integration with another service, your use of that service may also be governed by the third party's terms and privacy practices.
We are not responsible for third-party services outside our reasonable control, but this does not exclude any responsibility that cannot lawfully be excluded.
10. Fees
Some Connect Pro plans or features may be offered free of charge and others may require payment.
Before you purchase a paid service, applicable pricing, billing frequency, taxes and material subscription conditions will be disclosed to you.
Additional billing terms may apply to a paid subscription and will form part of your agreement with us where accepted.
We will not remove rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
11. Availability and maintenance
We aim to operate Connect Pro reliably but do not promise uninterrupted or error-free availability.
We may temporarily restrict access for maintenance, security, abuse prevention, legal compliance or urgent technical reasons.
Where reasonably practicable, planned maintenance affecting normal use will be communicated in advance.
12. Security
We use administrative, technical and organisational measures intended to protect Connect Pro and information handled through the service.
No online system can guarantee absolute security.
You must not attempt to circumvent authentication, authorisation, rate limits or security mechanisms, or access another customer's Workspace or data without authority.
13. Backups, exports and deletion
We may maintain backups and operational copies of information as part of running Connect Pro.
Deletion from an active system may not immediately remove information from backups where immediate removal is technically impracticable, although information retained solely in backup systems will remain subject to appropriate protections and will be removed or overwritten through normal backup lifecycle processes.
Where Connect Pro provides export or deletion functionality, you are responsible for using those functions as appropriate before closing an account.
Legal, security, fraud-prevention and record-keeping obligations may require us to retain certain information after account closure.
14. Intellectual property
Connect Pro, including its software, product design, documentation, trademarks and associated intellectual property, belongs to us or our licensors.
Except for rights expressly granted under these Terms, no intellectual property rights are transferred to you.
You may not copy, reverse engineer, resell, sublicense or commercially exploit Connect Pro except to the extent permitted by law or expressly authorised by us.
15. Feedback
If you voluntarily provide suggestions or feedback about Connect Pro, you permit us to use that feedback to improve the service without an obligation to compensate you.
This does not transfer ownership of your Customer Data.
16. Suspension and termination
You may stop using Connect Pro at any time, subject to any applicable paid subscription terms.
We may restrict or suspend access where reasonably necessary to address a material breach of these Terms, security risk, unlawful activity, abuse, non-payment of applicable fees, or a legal requirement.
Where reasonably practicable, we will give notice and an opportunity to remedy a breach before terminating access.
We may act immediately where delay would create a material security, legal or abuse risk.
We will not exercise suspension or termination rights in a manner prohibited by applicable law.
17. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law where that protection cannot lawfully be excluded or modified.
Where a remedy or liability can lawfully be limited, any limitation in these Terms applies only to the extent permitted by law.
18. Liability
To the extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when these Terms were entered into.
Nothing in these Terms limits liability where doing so would be unlawful, including liability arising from fraud or other liability that cannot legally be limited.
You are responsible for maintaining appropriate business continuity practices and for determining whether Connect Pro is suitable for workflows where interruption or loss could cause material harm.
Connect Pro is not intended to be relied upon as an emergency communications service or as the sole system for life-critical or safety-critical operations.
19. Indemnity
To the extent permitted by law, you are responsible for loss or claims arising directly from your unlawful use of Connect Pro, your material breach of these Terms, or Customer Data that you were not legally entitled to collect, use or disclose.
This provision does not apply to the extent a loss was caused or contributed to by us.
20. Changes to these Terms
We may update these Terms.
For material changes, we will take reasonable steps to notify affected users before the change takes effect unless an immediate change is required by law or for urgent security reasons.
The current version and effective date will be published with the Terms.
Where we require acceptance of a new version, Connect Pro may record the policy version and the time of acceptance.
21. Governing law
These Terms are governed by the laws of Tasmania, Australia, and applicable Commonwealth laws of Australia.
The parties submit to the courts having jurisdiction in Tasmania, subject to any rights under applicable law to bring proceedings elsewhere.
